General terms of use
Article 1 — Purpose
These terms define how users may access and use kestufela.fr. The site is a community platform for creating profiles, publishing content, participating in discussions and exchanging private messages.
Article 2 — Acceptance
Accessing and using the site implies full acceptance of these terms. Users who do not accept all or part of them are asked not to use the site.
Article 3 — Access
The site is free to access for anyone with an internet connection. Users bear all related costs, including equipment, software and connectivity. The publisher may interrupt or suspend access for maintenance or if these terms are breached.
Article 3 bis — Routes and map data
The optional Directions feature uses OpenStreetMap data under the ODbL licence and the FOSSGIS / OSRM service. It is activated by the user after consent; route availability and accuracy are not guaranteed.
Article 4 — User accounts
Some features require an account. Users undertake to provide accurate and current information and are solely responsible for use of their account and the confidentiality of their credentials.
Article 5 — User content
Users alone are responsible for the texts, images, messages, advertisements, links and other content they publish. They undertake not to publish content contrary to applicable laws and regulations, including defamatory, insulting, hateful, violent or discriminatory content or content infringing privacy or third-party rights.
Article 6 — Hosting status
As an individual publisher, the site publisher acts as host of user-published content within the meaning of Article 6-I-2 of the LCEN. The publisher cannot be held responsible for that content unless, after being duly informed of manifestly unlawful content, they fail to act promptly to remove it.
Article 7 — Personal data
The site may collect personal data necessary for operation, including account creation, messaging and security. Data are processed in accordance with the GDPR. See the privacy policy. Under applicable rules, users have rights of access, rectification, erasure and objection and may exercise them by contacting the publisher at the address above.
Article 8 — Changes to the terms
The publisher may change these terms at any time. Users will be informed of substantial changes when they next sign in.
Article 9 — Applicable law
These terms are governed by French law. If a dispute cannot be settled amicably, French courts alone have jurisdiction in accordance with ordinary legal rules.
Article 10 — Classified ads and contact between users
The site allows users to publish classified ads and contact each other to offer, seek or exchange goods, services or information. The publisher acts solely as a technical intermediary and is not party to any exchange, negotiation or contract between users.
Users acknowledge that the publisher does not verify the accuracy, legality or quality of ads; each user is responsible for their ads and their dealings and commitments with others; and every transaction, meeting or exchange is undertaken under the responsibility of the users concerned.
The publisher cannot be held responsible for disputes, loss or damage arising from an ad or contact, failure or poor performance of an agreement between users, financial loss, fraud or abuse. The publisher may moderate, suspend or remove an ad that is manifestly unlawful, fraudulent or contrary to these terms, without thereby assuming a general duty to monitor. Users must comply with applicable laws and regulations, particularly those relating to sales, services, undeclared work, tax and consumer protection.
Article 11 — Precautions when contacting or meeting users
Kestufela puts users in contact but does not take part in their exchanges, discussions or meetings, whether on or off the site. People met through an internet site are initially strangers, and information they provide cannot be guaranteed accurate or truthful.
Users must exercise caution and judgment: never share sensitive personal information such as an exact address, bank details, passwords or identity documents; prefer a busy, safe public place for a first meeting; tell someone close to you where, when and with whom you will meet; avoid excessive alcohol or substances that impair judgment; and end any exchange or meeting immediately if behaviour seems suspicious, inappropriate or dangerous.
Kestufela cannot be held responsible for damage, harm, assault, disputes, fraud or other incidents arising from exchanges or meetings between users, on or off the site. Each user is responsible for their decisions and behaviour. Unlawful conduct or a breach of these terms should be reported to the appropriate authorities and, where relevant, to the site publisher.
